MyWaterCalendar Terms of Use

These Terms cover your use of the MyWaterCalendar app, the premium subscription and the lifetime purchase. Section 3 contains an important health disclaimer, and section 4 sets out the subscription and auto-renewal terms — please read both.
1. Agreement
These Terms of Use ("Terms") are a legal agreement between you and Mobtive ("we", "us") governing your use of the MyWaterCalendar iOS application and any content or services it provides. By downloading or using the app you agree to these Terms. If you do not agree, do not use the app.
Your use of the app is also governed by the MyWaterCalendar Privacy Policy, and by Apple's Licensed Application End User Licence Agreement, which applies in addition to these Terms. Where Apple's agreement conflicts with these Terms, Apple's agreement prevails.
2. Licence
We grant you a personal, non-transferable, non-exclusive, revocable licence to use the app on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. You may not:
- copy, modify, translate or create derivative works of the app, except as permitted by law;
- reverse engineer, decompile or disassemble the app, except to the extent that this restriction is prohibited by applicable law;
- rent, lease, lend, sell, sublicense or redistribute the app;
- remove or obscure any proprietary notice; or
- use the app to break any law, or to interfere with its security or intended operation.
We retain all rights not expressly granted to you. The app, its design and its content remain our property.
3. Health disclaimer — please read
MyWaterCalendar is a general wellness and habit-tracking tool. It is not a medical device, and it does not provide medical advice, diagnosis or treatment.
- The daily hydration goal the app calculates is an estimate derived from a simple formula using the body weight, activity level and other details you enter, together with optional weather and fasting adjustments. It is not a clinical recommendation and is not personalised to your medical history.
- Individual fluid needs vary considerably and can be affected by medication, pregnancy or breastfeeding, kidney, heart or liver conditions, and other factors the app knows nothing about.
- Drinking too much water can be dangerous. Excessive intake in a short period can cause hyponatraemia, a serious drop in blood sodium. Do not treat the app's goal as a target to be exceeded.
- Always consult a qualified healthcare professional before making significant changes to your fluid intake, and follow your clinician's guidance over anything shown in the app.
- If you feel unwell, seek medical attention. Do not rely on this app in a medical emergency.
You use the app and act on its information at your own risk.
4. Subscriptions and purchases
MyWaterCalendar is free to use for logging, history, reminders and export. Premium features are available through an auto-renewing subscription or a one-time lifetime purchase.
Auto-renewing subscriptions. The following terms apply to the Monthly and Annual plans:
- Payment is charged to your Apple Account at confirmation of purchase.
- The subscription renews automatically at the same price and for the same period unless it is cancelled at least 24 hours before the end of the current period.
- Your Apple Account is charged for renewal within 24 hours prior to the end of the current period.
- You can manage or cancel your subscription, and turn off auto-renewal, in your Apple Account settings after purchase. Deleting the app does not cancel a subscription.
- If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
- Prices are shown in the app in your local currency before you confirm, and may vary by region. We may change prices for future periods with notice as required by the App Store.
Lifetime purchase. The Lifetime option is a one-time, non-consumable purchase. It does not renew and is not a subscription. It grants premium features for as long as the app remains available on your Apple Account.
Restoring. If you reinstall the app or use a new device, tap "Restore" on the paywall to recover a previous purchase made with the same Apple Account.
Refunds. Purchases are handled by Apple, and refunds are governed by Apple's policies — we cannot issue them directly. Request a refund at reportaproblem.apple.com. Consumers in the EEA and UK retain their statutory rights.
5. Advertising
The free version of the app displays advertising. Premium subscribers and lifetime purchasers see no ads. We do not control which specific ads are served, and the presence of an ad is not an endorsement. See the Privacy Policy for how advertising data is handled.
6. Your data and your responsibility for it
Your hydration log is stored on your device, not on our servers. This has one important consequence:
- We cannot recover your data. If you delete the app, lose your device or reset it without a backup, your log is gone and we have no copy to restore.
- Keep an iCloud or iTunes backup of your device, and use the in-app CSV export if the record matters to you.
7. Third-party services
The app can optionally use Apple Health, Apple's notification system, the Open-Meteo weather API, Google AdMob and RevenueCat. Those services operate under their own terms, we do not control them, and we are not responsible for their availability or content.
8. Availability and changes
We may update, change or discontinue the app or any feature at any time. We aim to keep the app working on currently supported versions of iOS but do not guarantee uninterrupted or error-free operation.
9. Disclaimer of warranties
To the fullest extent permitted by law, the app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will meet your requirements or that its calculations are suitable for your circumstances.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of your use of or inability to use the app. Our total aggregate liability is limited to the amount you paid us for the app in the twelve months before the claim arose.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded. If you are a consumer, these Terms do not affect your statutory rights.
11. Apple
You acknowledge that these Terms are between you and us, not Apple, and that Apple is not responsible for the app or its content. Apple has no obligation to provide support or maintenance for the app. Apple is not responsible for addressing any claim relating to the app, including product liability, regulatory compliance or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12. Termination
This licence continues until terminated. It ends automatically if you breach these Terms. You may end it at any time by deleting the app. Sections that by their nature should survive termination — including the health disclaimer, disclaimers of warranty and limitation of liability — will do so.
13. Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. If you are a consumer resident elsewhere, you retain the protection of any mandatory provisions of the law of your country of residence.
